
Capgemini gets relief from Court in a Harassment Case by a Software Techie Roshni Roy
The sessions court on Thursday set aside the issue process ordered by the Judicial Magistrate (First Class) against the Chairman and Chief Executive Officers (CEOs) of the company on Wednesday this week.
Last year, the Pune Court had issued summons to Capgemini India CEO in Workplace Harassment case on a complaint by a 42 years old female techie, Roshni Roy.
Roshini had filed a criminal complaint against the Capgemini, located at Talawade, and 20 of its officers for criminal breach of trust, cheating, and threatening her to resign, alleging that she was harassed and exploited by various officers of the company for many years.
The accused included are the Group Chairman and CEO, Paul Cermelin, Company CEO, Ashwin Yardli, Chairman Shrinival Kandula, and others.
Complainant Roshini was an employee (Associate Consultant) of Kanbay Software India Ltd, acquired by Capgemini Services India Ltd in 2007. Kanbay awarded her several increments and promotions b/w 1997 and 2008. However, no promotion came her way since 2008.
Roshni also complained that she was being repeatedly punished for one minor incident of security breach which did not cause any loss to the company. She even filed complaint at the Dehu Road police station and with the union cabinet minister for women and children.
The Case of Capgemini officers, Cermelin, Yardli and Kandula, was represented by advocates Harshad Nimbalkar and Shivam Nimbalkar, filed for a revision, seeking the quashing of the issue process order.
Advocate Harshad Harshad Nimbalkar argued in the court that The petitioner is CEO in Capgemini in France and he works outside the territory of India and, has nothing whatsoever to do with the allegations made in the complaint. He never came in direct contact with the complainant.
Harshad further submitted that the dispute is of civil nature and complainant has tried to colour it with allegations of criminal nature, pointing out that the complainant is still working in the company.
